Privacy Policy

More Than Gourmet, Inc., an Ohio corporation (the "Company," “we,” “us” or “our”) is committed to protecting the privacy of your personally identifiable information collected through morethangourmet.com (the "Site"). By using the Site, you consent to the terms of this Privacy Policy. If you do not agree with this Privacy Policy, do not use this Site. Information Collected

We collect two types of information from visitors to the Site: (1) personally identifiable information and (2) non-personally identifiable information. Except as provided herein, you may generally visit this Site without providing any personally identifiable information.

(1) Personally Identifiable Information

As used in this policy, “personally identifiable information” includes information that may be used to identify you personally, such as your name, address or e-mail address. Examples of manners in which we may collect your personally identifiable information include the following:

  • We may collect your name, e-mail address, mailing address, company name, and phone number if you register with the Site.
  • We may collect your name, address, e-mail address, date of birth and work history if you submit information to us in connection with an employment listing.
  • We may collect your name and other identifying information that you provide in connection with a testimonial or other remarks that you submit to us.
  • We may collect your first and last name, date of birth and email address if you choose to participate in a contest or sweepstakes.
  • We may collect your e-mail address and any other personally identifiable information provided if you contact us by e-mail.
  • We may collect your first and last name, address, and credit card and billing information if you make a purchase through the Site.

The above list provides an example of the personally identifiable information that may be collected on the Site. If you do not want the Company to collect your personally identifiable information, please do not provide it to us.

(2) Non-Personally identifiable information

As used in this policy, “non-personally identifiable information” can be technical information or it can be demographic information, such as your age, gender or interests. Non-personally identifiable information does NOT identify you personally. Here are some examples of the non-personally identifiable information that is collected via the Site and a description of how this information is used:

  • Internet Protocol (IP) address – Your IP address is a number that lets computers attached to the Internet know where to send you data – such as the webpages you view. We use this information to deliver our webpages to you upon request, to tailor our Site to the interests of our users and to measure traffic within our Site.
  • Cookie – A “cookie” is a small text file that may be used to collect information about your activity on the Site. For example, when someone visits a page within the Site, a cookie is placed on the user’s machine (if the user accepts cookies) or is read if the user has visited the Site previously. You may set most browsers to notify you if you receive a cookie, or you may choose to block cookies with your browser, but if you do, you may not be able to take advantage of the personalized features enjoyed by other users to our Site. Some of the cookies that we use may be Flash cookies or Adobe cookies. While they are harmless, they may contain Demographic Information (defined below) and depending on your browser these cookies may not normally be deleted when your cookies are deleted. Please check your browser to determine where these types of cookies are stored and how they may be deleted.
  • Web Beacons (also known as “clear gifs,” “web bugs” or “pixel tags”) – “Web Beacons” are tiny graphics with a unique identifier, similar in function to cookies, and are used to allow us to count users who have visited certain pages of the Site and to help determine the effectiveness of promotional or advertising campaigns. When used in HTML-formatted email messages, web beacons can tell the sender whether and when the email has been opened. In contrast to cookies, which are stored on a user’s computer hard drive, web beacons are embedded invisibly on web pages.
  • Demographic Information – “Demographic Information” may be your gender, age, zip code and interests, which you voluntarily provide to us on the Site. We use this information to provide you with personalized services and to analyze trends to ensure the information provided by the Site meets your needs. For example, we offer food options for individuals with certain food sensitivities and dietary needs and may consider updating our offerings based upon information collected through the Site.

Please note that we also consider aggregated information, which is not personally identifiable, to be non-personally identifiable information. The above list provides an example of the non-personally identifiable information that is collected via the Site.

 

How Information is Used

We use your personally identifiable information that is collected on the Site primarily for the following purposes:

  • To complete a transaction or service requested by you;
  • To alert you to recipes, special offers, and other updated information from the Company, or other third parties, or to forward promotional materials;
  • To complete a transaction or service requested by you;
  • To fulfill the terms of a promotion;
  • To ensure the Site is relevant to your needs;
  • To help us create and publish content most relevant to you;
  • To publish comments or remarks submitted by you in our marketing and advertising materials (note that no compensation will be provided);
  • To notify you about a material change to this Privacy Policy, if necessary;
  • To allow you access to limited-entry areas of the Site;
  • To determine your eligibility for an employment opportunity;

Non-personally identifiable information is used as described above and in other ways as permitted by applicable laws, including combining non-personally identifiable information with personally identifiable information. We may also tie non-personally identifiable information with personally identifiable information in order to ensure that the Site and our services meet your needs. When we tie non-personally identifiable information with personally identifiable information, it is considered “personally identifiable information” for the purposes of this policy. That means that we will be using and sharing this combined data in the manners described in the sections applicable to personally identifiable information.

 

How Information is Shared

We may share or disclose your personally identifiable information in the following instances:

  • To fulfill a service to you. For example, if you email us a question, we may use your email address to process your request and respond to your question. Also, if you are entering a sweepstakes or contest, we may use your personally identifiable information in order to fulfill the terms of that promotion. This means that we may share the information for prize fulfillment purposes or mail carriers. We also may share your information with the co-sponsor of that promotion.
  • To affiliates, strategic partners, agents, third party marketers or other unaffiliated parties who are offering products or services that we believe may be of interest to you or who require your personally identifiable information for research, administrative and/or internal business purposes. These parties may use your personally identifiable information to contact you with an offer or advertisement related to a product or service, or they may use such information for their own research, administration or business purposes. If you do not want us to share your personally identifiable information in this manner, please do not provide us with this information.
  • To unaffiliated third-party service providers, agents or independent contractors who help us maintain our Site and provide other administrative services to us (including, but not limited to, order processing and fulfillment, providing customer service, maintaining and analyzing data, sending customer communications on our behalf, and entry collection, winner selection and prize fulfillment for contests, sweepstakes and other promotions). We seek to ensure that these unaffiliated third parties will not use the personally identifiable information for any other purpose than to provide the administrative services for which they are responsible. Because such unaffiliated third-party service providers that help us administer our Site will have access to users’ personally identifiable information, if you do not wish for such providers to have access to your information, please do not register or submit any personally identifiable information to us.
  • To complete your purchase. If you choose to make a purchase on the Site, we may collect from you your credit card number, billing address and other information related to such purchase, and we may use such collected information in order to fulfill your purchase. We may also provide such information, or other personally identifiable information provided by you, to unaffiliated third parties as necessary to complete your purchase (for example, to process your credit card).
  • To comply with the law or in the good faith belief that such action is necessary in order to conform to the requirements of law or comply with legal process served on us, protect and defend our rights or property, including the rights and property of Company or act in urgent circumstances to protect the personal safety of our end users.
  • To third parties as part of any corporate reorganization process including, but not limited to, mergers, acquisitions, and sales of all or substantially all of our assets.
  • To track and analyze non-identifying and aggregate usage and volume statistical information from our visitors and customers and provide such information to third parties.
  • To protect against potential fraud, we may verify with third parties the information collected from the Site. In the course of such verification, we may receive personally identifiable information about you from such services. In particular, if you use a credit card or debit card to purchase services with us, we may use card authorization and fraud screening services to verify that your card information and address matches the information that you supplied to us, and that the card has not been reported as lost or stolen.

Except as provided in this Privacy Policy or as permitted by law, the Company does not disclose any personally identifiable information collected through the Site. 

Choice/Opt -Out

You can sign-up on the Site to receive e-mails and other communications from the Company concerning its products, recipes and other marketing efforts and promotions. Registering to receive these e-mails and communications is entirely voluntary. The Company does not purchase e-mail addresses and does not send e-mails and other communications to people that have not signed up to receive them, made a purchase with us, or otherwise contacted the Company or provided personally identifiable information. 

We communicate with our subscribers and customers regularly via e-mail. For example, we may use your e-mail address to confirm your request, to send you notices regarding your order, or to provide notices and other disclosures required by law. Generally, you cannot opt-out of these communications, but they will be primarily informational in nature rather than promotional.

However, you can stop receiving promotional e-mails from the Company at any time. If you do not wish to receive promotional e-mails from the Company, you may request to be taken off the Company's mailing list by contacting the Company by e-mail at info@morethangourmet.com or phone at 330-762-6652. Further, all promotional emails sent by the Company have a link that allows you to opt out of further promotional mailings. Upon receipt of such request, the Company will stop sending you promotional e-mails. Please allow the Company a reasonable time after your request to remove your contact information from its mailing lists. 

Site Security

The Company maintains reasonable physical, electronic and procedural safeguards to guard your personally identifiable information collected by this Site. In particular, the Company uses a secure server and all of your credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our payment gateway providers database, which is only accessible by those authorized with special access rights to such systems and whom are required to keep the information confidential. Any personally identifiable information submitted by you for any transaction submitted through the Site will be kept on file for at least 60 days in order to allow for order processing. 

Notwithstanding the foregoing, the Company and its affiliates do not ensure or warrant the security or accuracy of any information stored by the Site as no data transmission over the Internet can be guaranteed 100% secure. By submitting any information to the Site, you acknowledge that such information is not totally secure and agree to hold the Company and its affiliates harmless for any failure to maintain the security of such information. 

Passwords

Your account information and access to our Site are sometimes accessible only through the use of an individual password. To protect the confidentiality of personally identifiable information, you must keep your password confidential and not disclose it to any other person. Please advise us immediately if you believe that the confidentiality of your password has been compromised or that your password has been misused. In addition, always log out and close your browser when you finish your session. You will be responsible for any activity that takes place under your account via the use of your login information and password. Additionally, please note that we will never ask you to disclose your password in an unsolicited phone call or email.

Access

You may review and update your personally identifiable information by visiting “My Account” on the Site. You may also contact us to have your information deleted.

California Online Privacy Protection Act & YOUR CALIFORNIA PRIVACY RIGHTS

The Company has taken the necessary steps and precautions to be in compliance with the California Online Privacy Protection Act. If you are a resident of California, you may review your personally identifiable information collected by this Site by contacting the Company at the e-mail address or phone number listed in this policy and you may request the removal of such personally identifiable information from the Company's records. Further, the Company will not distribute your personally identifiable information to third parties without your consent or as provided in this Privacy Policy. 

Additionally, please note that the Site does not currently respond to any “Do Not Track” signals sent by browsers.

International Transfer of Information
If you choose to provide us with personally identifiable information, the Company may transfer that information to its affiliates and subsidiaries or to other third parties, across borders, and from your country or jurisdiction to other countries or jurisdictions around the world. If you are visiting from the European Union or other regions with laws governing data collection and use that may differ from US law, please note that you are transferring your personally identifiable information to the United States which does not have the same data protection laws as the EU and will not afford you many of the rights conferred upon data subjects in the EU. By providing your personally identifiable information you consent to:

  • the use of your personally identifiable information for the uses identified above in accordance with this Privacy Policy; and
  • the transfer of your personally identifiable information to the United States as indicated above.

Children's Privacy

The Site is not directed toward and does not intend to collect any personally identifiable information from children under the age of 13. If the Company determines that a child under the age of 13 has provided personally identifiable information in violation of this policy, the Company will delete such information from its files or database. 

Employment Information

The Company may make employment information or opportunities available on the Site. If you submit your resume or other personally identifiable information to the Company for any employment opportunity, the Company will not share such information with third parties, except as provided in this policy. The Company may circulate your personal employment information internally in order to consider your application and to contact you regarding a hiring decision. The Company may also contact you regarding other employment opportunities. 

Third-Party Links

This Privacy Policy applies only to this Site. For your convenience, this Site may contain links to other sites not owned, controlled or maintained by the Company. The Company is not responsible for and makes no representations regarding the privacy practices of these linked sites. The Company strongly encourages you to review the privacy policy of any linked site. 

Remarketing & Third-Party Advertising

Remarketing is a way for the Company to connect with people, based upon your past interactions with the Website and/or the Company. Third-party marketing vendors, ad networks and advertising companies may be permitted by the Company to perform remarketing services. Please be advised that such advertising companies may gather information about your visit to the Site or other sites (such as through cookies, web beacons and other technologies) to enable such advertising companies to market products or services to you, to monitor which ads have been served to your browser and which webpages you were viewing when such ads were delivered. As a result, third-party vendors, including Google, may show the Company ads on sites on the Internet. Please note that any information you include in a message you post to any chat room, forum or other public posting area is available to anyone with Internet access. If you do not want people to know your e-mail address, for example, do not include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION IN CHAT ROOMS, FORUMS AND OTHER PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE INFORMATION THAT YOU DISCLOSE IN CHAT ROOMS, FORUMS AND OTHER PUBLIC POSTING AREAS.

Modifications and Revisions

The Company may, in its sole discretion, modify or revise this Privacy Policy at any time. When we do, we will update the “Effective Date” noted below. Any changes or revisions to this Privacy Policy will be posted on the Site and effective immediately when posted.
